HB 4020 Rep. Daniels/Sen. Trotter - Provides that money follows
the individual from a state-operated facility to the community. Provides
that whenever any appropriation, or any portion of an appropriation, for any
fiscal year relating to the funding of any State-operated facility operated
by the Office of DD within the DHS or any mental health facility operated by
the Office of Mental Health within the Department is reduced, then those
moneys must be directed toward providing other services and supports for
persons with DD or mental health needs.

*HB 4022 Rep. Daniels/Sen. Hendon - Creates the Community DD
Services Medicaid Trust Fund consisting of funds paid to the State by the
federal government under Title XIX or Title XXI of the Social Security Act
for services delivered by community developmental disability services
providers. Provides that DHS shall reimburse community DD services providers
out of the Fund for Medicaid-reimbursed DD services provided to eligible
individuals.

CURRENT STATUS: Senate Rules Committee
HB 4723 Rep. Leitch Shell bill currently. Previously provided
that if DCFS contracts with a private child welfare agency to provide child
welfare services or to provide the arrangement of child welfare services,
then the private child welfare agency and its employees shall not, as a
result of their acts or omissions, be liable for civil damages, unless the
acts or omissions constitute willful and wanton misconduct.
POSITION: WATCH (sponsor indicated he wants to continue working on the
issue with all interested parties)
CURRENT STATUS: Passed the House 84-33-01
*HB 5000 Rep. Daniels - Provides that DHS may initiate a 2-year
pilot project aimed at the improvement of delivery of community-based
services by contract, which will increase the # of service contracts open to
a competitive selection process, increase the # of programs contracted on a
fee-for-service basis to attract federal Medicaid match dollars, and utilize
performance-based contracts in the provision of such services. Limits the
total amount of the contracts issued under the project or that are subject
to fee-for-service requirements to $64,000,000. Requires DHS to establish an
"ombudsman" system under the program. Requires an evaluation of the program
by an independent contractor. Provides that DHS must bill DPA separately for
services provided to recipients of medical assistance under Article V of the
Illinois Public Aid Code through the Division of MH and for services
provided to such recipients through the Division of DD. Inserts language for
a level payment plan (equal increments to help with cash management) and
phased in fee-for-service (money/service levels are commensurate with
previous years). Adds back language for a survey to be completed.

HB 5925 Rep. Mautino/Sen. Jacobs - Repeals the Small Employer
Group Health Insurance Law of the Illinois Insurance Code. Creates the
Illinois Consumer Choice of Benefits Health Insurance Plan Act. Provides
that insurers and employers may offer policies of accident and health
insurance that do not provide state-mandated health benefits.
POSITION: WATCH (depends on inclusion of MH parity)
CURRENT STATUS: Passed the House 82-30-03; Senate Rules Committee
SB 2454 Sen. Bomke - Shell bill currently, but will likely be
used for appropriation language related to the future of the Lincoln
Developmental Center.
